These terms govern your use of the Verve Freight website. They are not the contract that governs a shipment. Freight movements are governed by our shipper broker agreement, our broker carrier agreement, the applicable rate confirmation and the bill of lading.
Use of this website
You may use this site for legitimate business purposes. You may not attempt to interfere with its operation, access it through automated means that place an unreasonable load on it, or use it to transmit unlawful or harmful material.
Our role as a broker
Verve Freight is a licensed property broker. We arrange transportation. We do not operate our own motor carrier fleet and we do not take possession of freight. Motor carriers that haul freight arranged by Verve Freight are independent contractors, not our employees or agents.
Quotes
Rates quoted through this site or by our team are estimates based on the information provided and on market conditions at the time of quoting. A quote is not a binding contract until a load is confirmed and a rate confirmation is issued. Charges may change if the actual weight, dimensions, commodity, accessorial requirements or pickup and delivery conditions differ from what was provided.
Accuracy of information you provide
You are responsible for the accuracy of the shipment information you give us, including weight, dimensions, freight class, commodity description and any hazardous materials disclosure. Inaccurate information can result in additional charges, refused shipments, delays or liability.
Cargo liability and claims
Cargo liability is governed by the terms of the applicable transportation agreements and by federal law, including the Carmack Amendment where it applies. Carrier cargo coverage limits are not the same as full replacement value insurance. If you are shipping high value goods, tell us before the shipment moves so coverage can be addressed. Claims must be filed within the time limits set by the applicable agreement and by law.
Limitation of liability
To the fullest extent permitted by law, Verve Freight is not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, arising from your use of this website. Nothing in these terms limits liability that cannot be limited under applicable law.
Intellectual property
The content, layout, graphics and logos on this site are the property of Verve Freight or its licensors and may not be copied or reused without written permission.
Third party links
This site may link to third party websites. We do not control them and we are not responsible for their content or their privacy practices.
Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute relating to this website will be brought in the state or federal courts located in Texas.
